Termination of Spousal Support

Interim Support

The termination of spousal support in the interim, is 180 days after the judgement for divorce is granted. It may be terminated sooner or later upon a showing of good cause.

Final Periodic Support

Both Interim and Final Periodic Spousal Support may be modified if there is a material change in circumstances of either party. These types of support may be terminated if it has become unnecessary. Also, the remarriage of the person giving support does not constitute a material change in circumstance. See La. CC art. 114.

Interim spousal support or final periodic spousal support is extinguished when the following conditions are met:

  • upon the remarriage of the person receiving support;
  • the death of either party; or
  • a judicial determination that the person receiving the support has cohabited with another person of either sex in the manner of married persons. See La. CC art. 115.
