Termination of Spousal Support
The termination of spousal support in the interim, is 180 days after the judgement for divorce is granted. It may be terminated sooner or later upon a showing of good cause.
Final Periodic Support
Both Interim and Final Periodic Spousal Support may be modified if there is a material change in circumstances of either party. These types of support may be terminated if it has become unnecessary. Also, the remarriage of the person giving support does not constitute a material change in circumstance. See La. CC art. 114.
Interim spousal support or final periodic spousal support is extinguished when the following conditions are met:
- upon the remarriage of the person receiving support;
- the death of either party; or
- a judicial determination that the person receiving the support has cohabited with another person of either sex in the manner of married persons. See La. CC art. 115.
