An intrafamily adoption occurs between family relatives. This type of adoption is sometimes referred as the “stepparent adoption” because it allows stepparents to adopt their spouse’s children. They also apply to uncles, aunts, first cousins, grandparents, step-grandparent, or other family member to the twelfth degree, if the following conditions are met:

  1. The prospective parent is related to the child by blood, adoption, or affinity through a parent who has parental rights.
  2. The future parent is a single person over the age of 18 or a married person whose spouse is a joint petitioner.
  3. The prospective parent has had legal and/or physical custody of the child for at least six months prior to the filing of the petition.
